The previous post on children and divorce gave some hints about how to prepare. This post will explore the key statements you can use to help broach the subject with your kids.

Honesty with discretion is the best place to start. Once you’ve gathered everyone together, you can acknowledge that thing have not been going well. “Your Mom/Dad and I have been arguing a lot lately. We know it’s been hard for everyone. If you’ve made the painful decision to divorce, and have children, you may be wondering how to share the news with them – and how much difference the way you break the news makes.

In a 2002 clinical study of children and divorce, cited by Psychology Today, it was discovered that many kids remember, with excruciating detail, the moment when they were told that their parents were separating. In fact, the memory remained powerful long after the event itself was over. This suggest that, based on how you break the news, you can mitigate some of the trauma for your children – and preparation is the key. Below are some simple guidelines for how to prepare to tell your children about your divorce.

Have a Plan First

A well thought out plan for the future will be more reassuring to your family. So, don’t share the news with your kids until you have made a firm decision and developed a game plan regarding living arrangements and how daily life is going to run. Have your strategy organized and in place before you open up to the kids. Make sure that any necessary support people are in place and informed in advance. If it’s possible, troubleshoot your plan with a trusted friend or mentor. And, avoid unnecessary changes.

Practice! 

Allow yourself some private time to rehearse what you are going to say to your children, taking into account both their ages and personalities. “But . . . what about my kids?” This is the question that often plagues parents when their marriage is in trouble. They wonder if their children will be able to recover emotionally if they separate – or even divorce.

There’s no denying that divorce is challenging, and ideally would be avoided. But, what if a divorce is now inevitable? The reality is that HOW you handle the divorce is a big factor in how well your children will handle it emotionally – which means that you’ve got some control over the situation.

So, how can you effectively help your children navigate this difficult time? First, recognize that, just like you, they are grieving the loss of their formally-intact family and lifestyle, so you need to give them time to grieve. In fact, normal responses to separation and divorce include anger, anxiety, and even mild depression; typically, they ease with time.

Love, reassurance and a listening ear can go a long way towards helping your children deal with their feelings. When both parents can reassure their children that, even though they are divorcing, they both still love their children and will continue to be their parents, this usually smooths the path for an easier transition. Can’t get your spouse to cooperate? It’s still important that you do this.

You need to be watchful for red flag behaviors that may indicate the need for professional help.  These include excessive/uncontrolled anger, disordered sleep patterns, changes in social behavior (including withdrawal from friends or changing peer groups), drug/alcohol abuse, and trouble with school. When these behaviors surface, they are often your child’s way of calling out for help. Self-care is also important. Although it may seem counterintuitive, if your emotional, physical, and mental needs are met, you are better able to parent well. Children will assess how safe their world is based on the emotional strength and calm they see in Mom and/or Dad. So, if you as a parent are stable and attentive, they will perceive their world as secure – and security creates an environment for healing and restoration in your family.

The pain of divorce, while indisputable, is NOT the last word. Many children do make the adjustment successfully. And, as children heal, they often develop greater flexibility, tolerance, and coping skills, which can propel them forward to lead productive, happy lives. Child Support Lawyers

At our firm, we handle all types of child support matters including modifications of child support.  A motion to modify your child support may be asking the court for an increase or a decrease depending on whether yours or the other parent’s financial circumstances have changed substantially.

The most frequently asked question is:   How much is child support each month for my children?

There are several steps.  First you must determine whether you use Worksheet A or Worksheet B.

Worksheet A is used when one parent has primary physical custody of the minor children, which means that the parent has the minor children spend the night at their residence at least two-thirds of the year or at least 243 overnights out of 365 days in the year.

Worksheet B is used when both parents share custody of the minor children, which spend the night at both residences at least one-third of the year, or at least 123 overnights with each parent.

For example, if one parent has visitation every other weekend and two weeks in the summer, that is only 66 overnights per year and worksheet A would be used.

For example, if one parent has visitation every other weekend (52 overnights), every Wednesday night (52 overnights), and three weeks throughout the year for vacation and holidays (21 overnights), then that equals 125 overnights and worksheet B would be used.

 

Child Support FAQs

Q:  How do you calculate child support?

A:  Start with the gross monthly income of both parties.  Look at day care expenses, health insurance expenses, and other extraordinary medical expenses.  This is a good place to start.  Once you have these basic items, call our office at 704-992-1590 and we can walk you through the process.

Q:  Am I paying too much in child support?

A:  Possibly.  Call our office today and we can run the numbers for you to determine if you are paying too much in child support.

Q:  We agreed on child support by a separation agreement or consent order, is that enforceable?

A:  Technically no.  While parents may agree on a “number,” ultimately child support cannot be waived and the court will set the child support in the best interest of the child.  However, please note that parents agree to child support all of the time as a practical matter and it can save both parties thousands of dollars in child support litigation expenses until each child reaches 18 years of age.

Q:  Does child support include summer camps and college expenses?

A:  No.

Q:  My spouse is not taking a promotion or even took a job making less money to avoid paying child support.  Can my spouse do this?

A:  Yes, a person can voluntarily decrease their income.  But, the court may impute income to that person.  For example, if a person was making $100,000 per year in a sales job and decided to become a manager making $65,000 per year, then the court would impute $35,000 extra to that person’s income because the court would say that this person is capable of making more money.  Thus, for purposes of child support, the court would use $100,000 as the grossly income, not $65,000.

Q:  How do I decrease my child support?

A:  Increase your custody and go to a shared custody arrangement, which would use Worksheet B.  This is logical.  If you are spending more time with your minor children, then you will be spending more money on meals and care that you would otherwise just be sending in the form of a child support check.

Q:  How long do I have to pay child support?

A:  Until the child reaches the age of 18 years old or if a child is 18 years of age or older and is still attending high school.   Some other rare exceptions apply.   A parent may also file an action with the court to cease child support at any time once the child reaches 18 years of age.

Q:  Can I go to jail for not paying child support?

A:  Yes, the court has contempt power to sanction the non-paying party for not complying and even place a person in jail for failing to pay court-ordered child support.  Note:  If the child support is not court-ordered, then you may not be held in contempt.

You may have questions regarding the custody of your child.  Under North Carolina law, there are two types of custody as follows:  (1) legal custody and (2) physical custody.

(1) Legal Custody

(a) Joint Legal Custody.  Joint legal custody is when the court grants the same status to both parents and they shall have equal rights to be consulted and involved in any major and minor decisions regarding the child’s life.

For example, joint legal custody would enable both parents to decide what type of medical treatment the child may receive, where the child attends school, which friends the child associates with, how the child spends his or her vacation time, and all decisions that affect the child’s development and well-being.  Joint legal custody is the most common form of child custody.

Generally speaking, unless one parent has a significant drug addiction, mental disease, major physical problem, or is otherwise estranged or incarcerated, then most judges generally grant joint legal custody to both parents that are deemed to be fit and proper to raise a child.

(b) Sole Legal Custody.  Sole legal custody is different.  One parent has the exclusive right to all decisions regarding the child’s development and general well-being.  In some cases, a parent that is not fit to be a parent may opt to give the other parent sole legal custody.

(2) Physical Custody

Physical custody means which parent has the right to care and exclusive control over the child.For purposes of child support, physical custody is determined  by where the child spends the night.

(a) Joint or shared physical custody.  If a child spends at least 123 overnights or more with either parent, then the court defines that the parents have a joint or shared physical custody arrangement.

For example, with a joint physical custody arrangement, it is common that both parents have equal overnights with a child.  A child will spend the night at the mother’s house on odd weeks and at the father’s house on even weeks.  In layman’s terms, this is known as “flip-flopping,” and most judges do consider this arrangement if both parents live close by and are equally involved in the child’s life.

The age of the child is a factor that is considered when a judge decides on custody.  For example, a judge may not want to flip flop an infant back and forth because it may not be in the best interest of the infant’s stability.  However, more and more judges with progressive views are being elected to the bench.  It is important to have a child custody lawyer evaluate your case to help guide you through the court system in the event that you are assigned to a judge that does not believe in your same values and beliefs.

(b)Primary physical custody.  If a parent has a child for 122 overnights or less, then that parent has primary physical custody for purposes of child support.

The standard to determine which parent should have physical custody of a child is “the best interest of the child.”  No longer in North Carolina is there a tender years presumption that would require an infant or toddler to automatically be placed with his or her mother.

Statute of Limitations

Under North Carolina law, lawsuits for personal injury cases must be brought within three years from the date of the incident or occurrence.  The three year statute of limitations applies to all claims brought in North Carolina under common law negligence claims.

Wrongful Death Claims use a shorter two year statute of limitations.

Medical Malpractice claims follow the three year rule.  However, if a medical malpractice claim involves a wrongful death then the two year wrongful death rule applies and prevailsand the case is no longer considered a medical malpractice case for the purposes of the statute of limitations, but rather becomes a wrongful death case.

Can a statute of limitations be tolled or stop?  Yes.  The filing of a lawsuit stops the statute of limitations.

Discovery Rule

Under North Carolina Law, for injuries that cannot be discovered at the time of the incident or occurrence, the statute of limitations clock does not start to run until the victim’s injury becomes apparent or ought to have reasonably become apparent.  What does this mean? This means that sometimes you are injured and are not aware of your injury at the time it occurs, but begin to feel pain, discomfort, and symptoms at a later date. For example, you are involved in a major car accident.  Three months later, you begin to experience pain, discomfort  and may require a surgery.  Under this example, the likely date that the statute of limitations would start would be from the date of discovery, hence the fitting name for the discovery rule.

Delayed Tolling

Minors:  North Carolina law states that minors, persons under the age of 18, may bring a lawsuit within three years after reaching the age of majority.  Minors that suffer a traumatic event or significant injury at a very young age do not have the capacity to file a lawsuit. Often times, minors do not even understand the significance of their injuries until years later.  That is why North Carolina protects minors and gives the right to file a lawsuit until the age of 21.

Incompetency:  Persons that have been declared incompetent or suffer from a mental disability will have no statute of limitation to file a claim.  North Carolina courts have held that an“incompetent adult” means an adult or emancipated minor who lacks sufficient capacity to manage the adult’s own affairs or to make or communicate important decisions concerning the adult’s person, family, or property whether the lack of capacity is due tomental illness, mental retardation, epilepsy, cerebral palsy, autism,inebriety, senility, disease, injury, or similar cause or condition.

How Does Prayer for Judgment Continued Work?

Prayer for Judgment Continued is an option available to individuals charged with a variety of crimes. Instead of pleading innocent or guilty to the crime, the defendant can plead PJC. If the judge accepts the plea, the defendant avoids the penalties associated with the crime and a subsequent trial. Also, the conviction is usually not entered on the defendant’s permanent record, but this is at the court’s discretion.

As long as the defendant avoids another criminal conviction for three years, he or she will not suffer any consequences. However, if the defendant commits the same crime or another crime within that three-year time frame, he or she can face charges for both crimes.

North Carolina Dog Bite Laws

North Carolina has several different laws that can help a person that has been injured by a dog.  Generally, the owner of the dog is the person who is responsible. In addition, North Carolina law even holds a person that is the keeper or one who is harboring a dangerous dog.

There are four main laws that protect innocent citizens from dog bites.  North Carolina dog bite laws can be complex.  It’s important to call a North Carolina dog bite attorney.

“One Bite Rule”

To win a dog bite case, we need to prove that the owner or keeper of the dog is at fault. Many North Carolina dog bite attorneys will refer to the “one bite rule.” However, there really two ways to prove fault: knowledge of the potential danger or violation of a leash law. The best way to prove the owner knew the dog was dangerous is to have evidence that the dog attacked or bit someone else prior to your injury. This is where the “one bite rule” comes from. Usually, this means an owner of a dog that has not been previously known to be vicious or dangerous cannot be liable for the actions of that dog if it is involved in an attack, bite or maiming.

It is possible to show the owner of the dog should have known the dog was dangerous through other aggressive behavior short of an actual attack. 5. An adjuster contacted me about settling my case. Should I do it?

It is usually not a good idea to settle your claim with an insurance adjuster before you have finished your medical treatment.
